Definitions:
Terms relating to The Chapel Gym: “Gym, We, Our, Us.”
Terms relating to the the applicant: “You, Your, Member/s,”
1. Membership and Payment:
1. 1. Membership begins once you submit your joining information, select a membership plan, and pay the required fees. Your membership will continue as long as fees are paid and until you cancel your membership.
1.2. The following membership plans are available;
1.2.1. £20.00 Monthly Direct Debit Membership, for 12 Months
1.2.2. £14.00 VIP Monthly Direct Debit Membership for Over 50’s, for 12 Months
1.2.3. £12.00 Monthly Direct Debit For Those in receipt of benefits, for 12 months.
1.2.4. £6.00 Per session. Pay As You Go.
1.2.5. £25.00 1 Month membership. Pay As You Go.
1.2.6. £20.00 1 Month membership for Over 50’s. Pay As You Go.
1.3. You can cancel your membership at any time by writing to us and giving one months notice. Members may cancel their direct debit membership without penalty. However only pay as you go membership will be available when rejoining the gym. At management discretion members may rejoin a direct debit scheme if a genuine reason is provided.
1.4. Membership Fees may be paid by following methods, according to the terms of the individual membership plan:

1.5. Membership fees are non-refundable, except as required by law. If you cancel your membership, you will not be entitled to a refund for any unused portion of your membership fees except for when a membership agreement was not made on our premises or due to long term illness which would limit gym use or pregnancy. Then you have 14 days in which to cancel your membership and we will refund you, minus transaction fees and any fees calculated for any use of our facilities in those 14 days.
1.6. We reserve the right to change our membership plans and fees at any time. We will notify our members of any changes to our membership plans and fees through our website, email, or any other means we deem appropriate.
1.7. If your payment is declined or otherwise not received, your membership may be suspended or terminated at our discretion.
1.8. You agree to provide accurate and complete payment information when you join as a member. If your payment information changes, you are responsible for updating it promptly to ensure uninterrupted membership access.
1.9. Memberships are non-transferable, and members may not allow any other person to access the gym premises or use the equipment on their behalf. Any member found sharing their membership or allowing another person to access the gym premises or use the equipment on their behalf will be charged a fine of £20.00, in addition to being charged for the other person's use. The gym reserves the right to suspend or terminate the membership of any member found in violation of this clause without refund or compensation. Members are responsible for any damage caused to the gym premises or equipment by themselves or their guests, and will be charged for any repairs or replacements required as a result of such damage.
2. Gym Access and Hours:
2.1. Your membership entitles you to access the gym during our opening hours, which are Monday to Friday from 6:00am to 10:00pm, and Saturday and Sunday from 8:00am to 6:00pm. These hours are subject to change at our discretion, and we will make every effort to notify our members of any changes.
2.2. Access to the gym is subject to availability and capacity limitations. We reserve the right to limit or restrict access to the gym at any time, including during peak hours or to accommodate maintenance, repairs, or other circumstances.
2.3. We reserve the right to change our opening hours without prior notice. We also reserve the right to remain closed on bank holidays and other days of the year at our discretion.
2.4. We will make every effort to notify our customers of any changes to our opening hours through our website, social media channels, and any other means we deem appropriate.
2.5. Members aged 16 and over can use all our equipment. Children aged between 13 and 15 are permitted to use the gym when accompanied by a responsible adult, but cannot use free weights or plate-loaded machines.
3. Gym Usage Rules:
3.1. You are responsible for complying with all gym rules and regulations, which may be posted or communicated to you by gym staff or management. Failure to comply with gym rules and regulations may result in the suspension or termination of your membership at our discretion.
3.2. Gym rules are as follows
3.2.1. Use equipment safely and correctly. Please consult with gym staff if you are unsure about how to use any equipment properly.
3.2.2. Wear appropriate gym attire, including athletic shoes and clothing that is comfortable and non-restrictive.
3.2.3. Clean equipment after use with provided disinfectant spray and wipes.
3.2.4. Do not drop or slam weights or equipment. Return weights after use
3.2.5. Do not bring outside equipment or food, chewing gum or drink (except for water in a sealed container) into the gym.
3.2.6. Respect others by keeping noise to a minimum and allowing others to use equipment when you are resting between sets.
3.2.7. Do not engage in any behaviour that may be disruptive or dangerous to others, including but not limited to aggressive behaviour, verbal abuse, or harassment.
3.2.8. Report any broken or malfunctioning equipment to gym staff immediately.
3.2.9. Do not engage in any unauthorised training or instruction in the gym.
3.2.10. Do not use chalk, liquid chalk is permitted.
3.2.11. Follow the instructions of gym staff at all times.
4. Car Parking Facilities:
4.1. Members of our gym have free access to our car parking facilities while using the gym. By using our car parking facilities, you agree to be bound by these terms and conditions.
4.2. Members must ensure that they enter their car registration details at reception when they arrive at the gym to avoid a parking fine.
4.3. We accept no liability for any loss or damage to vehicles parked on our premises, except where such loss or damage is due to our staff's negligence.
4.4. We reserve the right to refuse access to our car parking facilities to any individual or vehicle.
5. Health & Safety:
5.1. You are responsible for your own health and safety, and should consult a doctor before beginning any exercise program.
5.2. All members are required to complete a Physical Activity Readiness Questionnaire (PARQ) form prior to commencing any physical activity at the gym. The PARQ form is mandatory for individuals who have any pre-existing medical conditions and/or are within the age range specified in the PARQ form. By completing the PARQ form, members confirm that they are aware of any health risks associated with physical activity and accept full responsibility for any injury or illness that may result from participation in any gym activities.
5.3. Personal trainers at our gym may be self-employed. Any advice is their own and any service they provide is charged at their determined rate and remains a contract between them and you. We cannot accept any responsibility if a personal trainer breaks the contract or is negligent.
5.4. If you have not used a gym before you agree to make use of our free gym induction with one of our personal trainers. Information of how to book a gym induction can be found on our website and in your welcome email.
6. Unstaffed Hours: (Currently not operational)
6.1. Use of the gym during unstaffed hours is at your own risk. By entering the gym during unstaffed hours, you agree to assume all risks associated with your use of the facilities.
6.2. You are responsible for ensuring that you use the gym equipment and facilities safely and properly. Any damage caused to the gym equipment or facilities during unstaffed hours will be your responsibility and may result in the loss of access to the gym during unstaffed hours.
6.3. You must comply with all safety measures and rules posted in the gym during unstaffed hours. Failure to comply with these safety measures may result in the loss of access to the gym during unstaffed hours.
6.4. You agree to be respectful of local residents by entering and leaving the gym car park and building quietly during unstaffed hours.
6.5. You must use the panic button system provided, and keep it close to you at all times, when the gym capacity is below 5%. Panic alarms must be returned when you are finished training.
6.6. We reserve the right to revoke your access to the gym during unstaffed hours at any time for any reason, including but not limited to violations of these terms and conditions, safety concerns, or gym policy changes.
7. Liability:
7.1. We will not accept liability for any death, personal injuries or damages that may occur while using our gym facilities or equipment, on the premises or within the grounds of the Chapel Gym, which is not caused by our negligence. If you suffer an accident or injury on our premises, you must report it and the circumstances under which it happened, to a member of staff immediately.
7.2. We will not accept liability for any loss or damage to personal property while on our premises, including but not limited to theft or damage to personal items stored in lockers or left unattended.
7.3. We are not liable for any lost or stolen items, including personal belongings, jewellery, or cash.
7.4. Nothing in this agreement limits any liability which cannot legally be limited, including but not limited to liability for:
7.4.1. Death or personal injury caused by negligence.
7.4.2. Fraud or fraudulent misrepresentation.
7.4.3. Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982.
8. Data Privacy:
8.1. The Chapel Gym is committed to protecting the privacy and security of our users' personal data.
8.2. The Chapel Gym complies with its obligations under the GDPR by keeping personal data up to date, storing and destroying it securely, not collecting or retaining excessive amounts of data, protecting personal data from loss, misuse, unauthorised access and disclosure, and ensuring that appropriate technical measures are in place to protect personal data. These measures include secure storage, data encryption, access controls, and staff training.

8.8. We keep data in accordance with the guidance set out in the GDPR. Specifically, we retain membership data while it is still current and relevant, financial records and other personal data for as long as necessary to fulfil the purposes for which it was collected, including the satisfaction of any legal, accounting, or reporting requirements..
8.9. Users have the following rights regarding their personal data:
8.9.1. The right to request a copy of your personal data which the Chapel Gym holds about you;
8.9.2. The right to request that the Chapel Gym corrects any personal data if it is found to be inaccurate or out of date;
8.9.3. The right to request your personal data is erased where it is no longer necessary for the Chapel Gym to retain such data;
8.9.4. The right to withdraw your consent to the processing at any time;
8.9.5. The right to object to the processing of personal data, where applicable.

9. Changes to Terms and Conditions:
9.1. We reserve the right to change these terms and conditions without prior notice. However, we will notify you of any changes made to these terms and conditions via email, website or other reasonable means.
